How to Report Trademark Infringement on Facebook

Step 1: Identify the Type of Infringement

Facebook removes listings and posts that infringe intellectual property rights across five primary categories: counterfeits, copyright infringement, trademark infringement (including brand abuse), design infringement, and patent infringement.

Trademark Infringement
Trademarks include distinctive elements such as names, logos, slogans, symbols, or designs used to identify the source of goods or services. Unauthorized use of these elements may constitute trademark infringement.

Counterfeiting
Counterfeiting is a specific form of trademark infringement involving the unauthorized use of identical or substantially similar trademarks on products, misleading consumers into believing they are purchasing genuine goods.

Note on Lookalikes and Replicas
Even when trademarks are not directly used, lookalike or replica products may still infringe other IP rights such as copyright, design rights, or patents, and can harm brand reputation and consumer trust.

Brand Abuse
Brand abuse refers to broader forms of trademark misuse, including impersonation accounts, misleading business pages, false associations, or unauthorized use of trademarks in advertisements.

Copyright Infringement
Copyright protects original works such as text, images, videos, music, software, and other creative content. Unauthorized use, reproduction, or distribution of such works constitutes copyright infringement.

Design Right Infringement
Design rights protect the visual appearance of products, including shapes, patterns, and configurations. These rights can be enforced against products that replicate distinctive design elements.

Patent Infringement
Patents protect inventions and grant exclusive rights to the patent holder. Unauthorized use, sale, or distribution of patented inventions may constitute patent infringement.
